O casamento é uma instituição que visa a união de duas pessoas, tendo como fundamento a vontade de constituir família. Todavia o sentimento existente entre eles se dirime e essa tal sonhada instituição chega ao fim.
Antes da emenda constitucional n° 28/2009 necessitava-se de proceder primeiramente com a separação judicial ou de corpos para depois de um ano dessa decisão promover o divórcio, isto é, a conversão da separação em divórcio. Ou, outrossim, promovia-se o divórcio direto se o casal havia separado de fato há mais de dois anos.
Com o advento da emenda constitucional n° 28/2009 a situação mudou. Não se necessita mais da separação judicial, podendo ser instaurado diretamente o divórcio, sem atender aos critérios antes aqui mencionados.
Não houve uma alteração na legislação infraconstitucional, significando que a separação judicial não acabou. Todavia ela tornará-se inócua, vindo a cair em desuso.
Há quem critique essa medida, porquanto banalizará a instituição do casamento, sendo, em tese, fácil a dissolução do mesmo, até porque muitos que promovem a separação judicial se reconciliam pouco tempo depois.
Quando da decretação da separação judicial a reconciliação é simples, feita por meio de petição. Já o divórcio é necessário casar de novo ou conviver em união estável.
Apesar da facilitação da dissolução do casamento, há outras questões que devem se resolvidas no divórcio que, as vezes, não serão tão simples, entre elas, os alimentos, a guarda dos filhos, as alienações parentais e a partilha de bens.
Frise-se que o casamento será dissolvido, igualmente, pela via administrativa, a qual é feita pelos cartórios, cujo tempo de tramitação é bem inferior as demandas judiciais.
Essa modificação constitucional era por muito tempo o desejo de muitos que sentiam na pele a dificuldade e burocratização da dissolução do casamento que muitas vezes se estendiam por anos nas secretarias do Judiciário.
